Prenuptial Agreement

A prenuptial agreement was a legal document signed prior to a marriage, in which the rights and responsibilities with regard to property were clearly outlined. In the colonial era, prenuptial agreements were uncommon. Under the law, marriage usually translated into limited legal rights for a woman. A prenuptial agreement could insure that she, even though a "feme covert," might retain the right to control her own property or make a will.
